Welcome to the website of Futzil, a 501(c)(3) nonprofit organization committed to promoting equity in sports by supporting impoverished youth through charitable donations of sporting goods and financial contributions. These Terms of Service (“Terms”) govern your use of our website [https://futzil.com] (the “Site”) and any services, content, or features offered by Futzil (collectively, the “Services”).

By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

 

Eligibility

You must be at least 13 years of age or the legal age of majority in your jurisdiction to use this Site. If you are under 13, do not use this Site or provide any personal information.

 

Use of the Site

You agree to use the Site only for lawful, non-commercial purposes related to Futzil’s charitable mission. You must not:

• Use the Site for any fraudulent or illegal purpose
• Attempt to gain unauthorized access to any part of the Site or Services
• Disrupt or interfere with the Site’s operation or security
• Use automated means to access the Site (e.g., bots, crawlers)

 

Donations and Contributions

All donations made through our Site are voluntary and non-refundable unless required by law. Futzil uses a third-party payment processor, Stripe, to securely handle your donation and payment information. We do not store full payment details on our servers.  Payment processing services provided by Stripe are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”).  By agreeing to Futzil’s Terms of Service, you agree to be bound by the Stripe Services Agreement, and the same may be modified by Stripe from time to time. As a condition of Futzil enabling payment processing services through Stripe, you agree to provide Futzil accurate and complete information about you and/or your business, and you authorize Futzil to share it and transaction information related to your use of the payment processing services provided by Stripe.

Donors will receive a confirmation receipt and, when applicable, a tax-deductible receipt as allowed by IRS guidelines.

 

User Content and Submissions

If you submit or post content (e.g., comments, testimonials, photos), you grant Futzil a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, publish, and distribute such content in connection with our mission and operations.

You are solely responsible for the content you submit and must not submit anything unlawful, offensive, or infringing on others’ rights.

 

Intellectual Property

All content on the Site, including logos, graphics, text, images, and software, is the property of Futzil or its licensors and is protected under U.S. and international copyright, trademark, and intellectual property laws.

You may use content solely for personal and non-commercial purposes related to Futzil’s work. Any other use requires prior written consent.

 

Third-Party Links

Our Site may link to third-party websites. These links are provided for your convenience, and Futzil does not endorse or control these sites. We are not responsible for their content, practices, or terms.

 

Disclaimer of Warranties

The Site and Services are provided “as is” and “as available.” We make no warranties, express or implied, about the Site’s operation, accuracy, or availability. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in New York, New York.
